DSP Qadri shot my son with his pistol when we were watching TV: Mir
Chief Judicial Magistrate (Srinagar), Masarat Shaheen today ordered issuance of non-bailable warrant against Senior Superintendent of Police (Srinagar) for not complying with the court order in which he was directed to lodge FIR against a DSP-rank police officer for allegedly killing a youth in Batamaloo area of Srinagar.
According to the report in Indian Express: The SSP Srinagar Amit Kumar had sought exemption from the personal appearance which the court rejected and issued a non-bailable warrant against him to be executed through DIG Central Kashmir.
The Court further directed the Chief Prosecuting Officer, who was present in the court, to forward non-bailable warrant to DIG Central Kashmir and file compliance report before the court within two days.
“The SSP Srinagar is further directed to show cause as to why contempt proceedings shall not be initiated against him for not obeying the court directions, whereby he was directed to lodge FIR and file a copy of the FIRwithin 24 hours,’’ read the order.
Earlier in violations of the city court orders, police had lodged an FIR against the killed youth, Shabir Ahmad Mir, as an accused.
The prosecution had also told the court that police has named Mir as an accused in FIR 89/2016 and he was booked under several charges of Ranbir Penal Code, including rioting, attempt to murder and assault on a public servant.
Police had further told the court that the youth was leading a procession the day he was killed.
The court, however, rejected the police argument and issed a fresh direction to the SSP Srinagar to lodge the FIR against DSP Yasir Qadri and file a copy it before the court within 24 hours.
According to the application filed by Mir’s father, Abdul Rehman Mir, before the court, a police team led by Qadri barged into their home and killed Shabir.
“When they (Mir’s family members) were watching television, a police party headed by DSP Qadri barged into the house and started smashing window panes and doors. The wife of the applicant tried to stop the said police officer, but he physically assaulted her. The son (Shabir) could not tolerate the thrashing of his mother and tried to rescue her from the clutches of the police officer. The police officer took out his pistol and fired two shots at him, resulting in his on-the-spot death,” the application read.
Abdul has also claimed that SHO concerned refused to file the case after his son was killed.
